These Terms and Conditions (“Terms”) govern your use of alicesheart.org and any pages, forms, content, or services made available through the Website (collectively, the “Website”). The Website is operated by Alice’s Heart Inc., a Georgia nonprofit corporation (“Alice’s Heart,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.
1. Purpose of the Website
The Website provides information about Alice’s Heart, maternal and family support programs, events, community resources, volunteer and partnership opportunities, fundraising, donations, and ways to request or receive assistance.
Information on the Website is provided for general educational and informational purposes. Website content does not create a healthcare provider-patient, attorney-client, counselor-client, fiduciary, or other professional relationship.
2. No Medical Advice or Emergency Services
Alice’s Heart is not a healthcare provider, and the Website and our community programs do not provide medical diagnosis, treatment, monitoring, or emergency response. Health-related information is general and is not a substitute for advice from a qualified healthcare professional who knows your circumstances.
Never disregard or delay professional medical advice because of information on the Website or from an Alice’s Heart program. If you believe you or another person is experiencing a medical emergency, call 911 or seek immediate medical care. Website forms, email, and text messages are not monitored as emergency channels.
3. Eligibility, Applications, and Availability
Program descriptions, eligibility criteria, schedules, benefits, supplies, referrals, stipends, incentives, and services may change and are subject to funding, capacity, geography, partner availability, and other limitations. Submitting an application or registration does not guarantee eligibility, enrollment, acceptance, assistance, a particular benefit, or attendance.
You agree to provide information that is accurate and complete to the best of your knowledge. We may request additional information, verify eligibility, correct errors, place participants on a waitlist, deny or discontinue participation, or modify or cancel a program or event when reasonably necessary.
Unless a form expressly states otherwise, you must be at least 18 years old to submit an application, consent, donation, or registration. A parent or legal guardian must act for a minor.
4. Donations
Donations are voluntary and are processed through PayPal or another identified payment provider. Payment processing is also subject to the provider’s terms and privacy policy.
Unless otherwise stated, donations support Alice’s Heart’s charitable mission and may be used where the need is greatest. A donor restriction or designation is effective only if Alice’s Heart expressly accepts it. Alice’s Heart may redirect a restricted donation if the stated purpose becomes impossible, impracticable, fully funded, or inconsistent with legal or charitable requirements, to the extent permitted by law and any applicable agreement.
Donations are generally nonrefundable. If you believe a donation was made in error or without authorization, contact us promptly. Alice’s Heart will review refund requests individually. Nothing on the Website is tax advice. The deductibility of a contribution depends on applicable law and your circumstances; consult a qualified tax professional.
5. Communications
When you provide contact information, Alice’s Heart may respond to your inquiry and send administrative communications reasonably related to an application, donation, registration, service, event, volunteer role, or partnership.
Where you separately consent, we may also send promotional, fundraising, or organizational emails and text messages. Consent to promotional texts is not a condition of donating or receiving assistance. Message frequency may vary, and message and data rates may apply. You may opt out of promotional texts by replying STOP and may unsubscribe from promotional emails using the available unsubscribe link or by contacting us. You agree that electronic records and communications may satisfy legal requirements that communications be in writing, to the extent permitted by law.
6. Acceptable Use
You may use the Website only for lawful purposes. You may not:
- Submit false, misleading, fraudulent, harassing, threatening, discriminatory, or unlawful material.
- Impersonate another person or misrepresent your identity, eligibility, authority, or affiliation.
- Attempt to gain unauthorized access to the Website, forms, accounts, systems, or data.
- Introduce malware, disrupt Website operation, evade security controls, scrape or harvest personal information, or use automated tools in a manner that burdens or harms the Website.
- Copy, modify, distribute, sell, or exploit Website content except as permitted by law or with our written permission.
- Use Alice’s Heart’s name, logo, content, or programs to imply endorsement, sponsorship, partnership, or authorization without written permission.
We may restrict or terminate access, reject submissions, and take appropriate action if we reasonably believe these Terms have been violated.
7. Intellectual Property
The Website and its original text, graphics, logos, program names, photographs, videos, downloadable materials, design, and other content are owned by or licensed to Alice’s Heart and are protected by applicable intellectual-property laws. Alice’s Heart grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for personal, noncommercial, lawful purposes.
You may share an unaltered link to public Website content. Any other reproduction, adaptation, publication, commercial use, or creation of derivative works requires prior written permission unless permitted by law.
8. Materials You Submit
You retain ownership of original materials you submit. You grant Alice’s Heart a nonexclusive, royalty-free license to use, store, reproduce, and share those materials only as reasonably necessary to respond to your request, administer a program or event, provide a service or referral, maintain records, protect safety, comply with law, or fulfill another purpose disclosed when you submit them.
Submitting a story, photograph, testimonial, or media file does not by itself authorize Alice’s Heart to use it publicly for marketing unless the applicable form clearly requests and documents that permission. A separate written media or testimonial release, when used, controls that public use.
9. Third-Party Services and Links
The Website may contain links to or integrations with third parties, including PayPal, Jotform, healthcare organizations, government agencies, community partners, and resource providers. We provide these links for convenience and do not control or guarantee third-party content, privacy, security, eligibility decisions, services, or availability. Your use of a third-party service is governed by that provider’s terms and policies.
A link, listing, referral, or participation in an event does not necessarily mean Alice’s Heart endorses every statement, product, service, or practice of the third party.
10. Website Information and Availability
We work to provide useful and accurate information, but we do not warrant that Website content is complete, current, error-free, or suitable for every situation. Resources, links, event details, and eligibility information may change without notice. The Website may be unavailable or modified from time to time.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, Alice’s Heart and its directors, officers, employees, volunteers, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Website, third-party services, or reliance on Website content.
Alice’s Heart does not exclude or limit liability where doing so is prohibited by law, including liability that cannot legally be waived. These limitations apply only to Website use and do not replace or limit any rights or responsibilities stated in a separate written program, event, service, or partnership agreement.
13. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the Website, your fraud or intentional misconduct, or your material violation of these Terms. This section does not require you to indemnify Alice’s Heart for its own negligence or unlawful conduct.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction in Georgia, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms as the Website, programs, or legal requirements change. The revised Terms will be posted on the Website with an updated date. Changes apply prospectively from the stated effective date. Your continued use of the Website after that date constitutes acceptance of the updated Terms.
16. General Terms
If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement concerning use of the Website, but a separate written agreement or consent form may govern a particular program, event, service, donation, volunteer role, or partnership. If there is a direct conflict, the more specific written agreement controls for that subject.
17. Contact Us
Questions about these Terms may be submitted through the Contact page at alicesheart.org or by calling 404-423-2611 .
